Common questions

When did the hospice election statement addendum become mandatory?

For hospice elections on or after 1 Oct 2026 (42 CFR 418.24(b)(6), (c), (d)).

How many days does a hospice have to give the addendum?

Within 5 calendar days of the election effective date. When an unrelated item, service or drug changes in the plan of care, the update is due within 3 calendar days (CMS MLN Connects, 1 Oct 2026).

Will Medicare deny a claim if the addendum is missing?

From 1 Oct to 31 Dec 2026, CMS says Medicare contractors will not deny claims solely because the addendum is missing or incomplete. The requirement itself already applies.

What is the "date furnished" on the addendum?

The date the patient or representative receives the addendum. It is not the signature date (CGS).

Does the patient have to agree with the addendum?

No. The signature confirms receipt only. If the patient refuses to sign, the hospice records the reason on the addendum.

What must a hospice election statement include?

The hospice and attending, the patient's choice of attending, the palliative nature of care, coverage information and waived services, the effective date, cost-sharing, BFCC-QIO information, the addendum, and a signature (42 CFR 418.24(b)). Part A of this check covers each one.

What if the patient dies before the addendum is signed?

If the patient dies, revokes or is discharged before the addendum is given, it is not required, but the reason goes in the medical record. If it happens before the patient signs, no signature is needed for payment, and the reason goes on the addendum (42 CFR 418.24(d)(3), (d)(4)).
